Car seat rules in private hire vehicles aren't complicated, but they're rarely explained properly. Here's the definitive answer — and what it means when travelling with KinRoute.

What the law says

In the UK, children must use an approved car seat in any private car, van or goods vehicle until they are 135cm tall or 12 years old — whichever comes first. After that, they must wear an adult seatbelt.

Licensed taxis and private hire vehicles are treated differently under the law. If the driver does not provide the correct child car seat, children can travel without one — but only if they travel on a rear seat and wear an adult seatbelt if they're 3 or older.

There is one important condition: if a suitable child seat or booster seat is available, it must be used by all children under 12 years of age or under 135cm tall. The exemption only applies when no seat is provided.

So is a car seat optional in a private hire vehicle?

Not exactly. The law permits travel without a car seat in a licensed private hire vehicle when none is available — but this is a practical exemption, not a safety recommendation. In plain terms: legally, children aged 3 and over can travel in a licensed private hire vehicle without a car seat, wearing an adult seatbelt in the rear.
